📖 The Fiqh & Governance of Dividend Purification
In modern publicly traded corporations, virtually every enterprise holds operational working capital in conventional bank accounts that accrue minor interest (Riba), or engages in secondary transactions involving prohibited income (such as incidental pork/alcohol sales in airline catering or entertainment royalties).
1. The Theological Mandate: Resolution No. 63 (1/7)
The OIC Islamic Fiqh Academy in Jeddah and AAOIFI Shariah Standard No. 21 (Clause 3/4) established that owning shares in mixed-income companies is permissible only on the strict condition that any revenue derived from interest or prohibited activities is segregated and expunged from the investor's balance sheet.
Purification Due = Total Cash Dividend Received × Purification Factor
2. How to Disburse Purified Funds
Shariah governance boards have set down strict protocols regarding where and how tainted dividend funds must be disbursed:
- No Expectation of Spiritual Reward (Thawab): When donating purified funds, you must not intend it as voluntary charity (Sadaqah) earning heavenly reward. It is the disposal of tainted wealth that never belonged to you in the sight of Allah.
- Not Deductible as Zakat: Purified funds cannot be counted toward your annual 2.5% Zakat obligation. Zakat must be paid exclusively from pure, wholesome wealth (Tayyib).
- No Personal Tax Benefit: Scholars stipulate that an investor must not exploit charity tax deduction receipts from purified funds to lower their personal income tax liability.
- Permissible Beneficiaries: Funds should be directed toward public utility works (sanitation, public drinking water, paving roads), relief for the destitute, or general humanitarian aid where no personal benefit returns to the donor.
3. Do Capital Gains Require Purification?
Under AAOIFI Standard No. 21, capital gains realized from selling shares at a market price appreciation are not subject to purification. The rationale is that market share price reflects investor expectations, intellectual property, brand equity, and future discounted earnings—not accumulated cash interest. However, scholars such as Mufti Muhammad Taqi Usmani advise conservative investors to apply the purification percentage to capital gains if held across quarterly dividend dates.
